Ruling "Not Until At Least Tuesday"

By Gabe Bullard

Filed Wednesday, September 26, 2007 at 2:18 PM

Those awaiting the outcome of the trial to decide control of St. Louis Public Schools will have to hang on for another six days. According to SLPS spokesperson Deborah Sistrunk, Judge Richard Callahan has said he does not expect to make a ruling until at least next Tuesday.

You'll have to wait longer than that. The trial will continue (and hopefully conclude) next Tuesday. The ruling won't come then, the judge has to sift through all the legal arguments, which aren't part of the testimony, and then write his opinion. It'll take as long as it takes.

Among the questions for which I cannot get answers:

1.What is the legal status of Rick Sullivan's appointment, withdrawal, and either reappointment or automatic disqualification as of September 19th?

2.It appears to me that slps has changed from a situation where voters go to the polls and choose board members, to a murky, ill-defined system where a 3 person board is chosen where voters have ultimate control OVER TWO MEMBERS, because they have electoral say over who is mayor and president of the board of aldermen, BUT, BUT, BUT--------the key person----the ceo-member is chosen by the statewide voters through the governor, and is subject to being acceptable to a senator who does not answer to st. louis voters at all. Will this reality be considered by the judge regarding the legal status of the sab?

3.I am still searching the labyrinths to answer a basic question about attendance---was the percentage of enrolled students showing up to school over the 175 days in 2006-2007 higher or lower than in 2005-2006?

4.Why has there been no pubdef report on two public sab meetings, nor upon the forum hosted by antonio himself? Is there anyone other than Steve Giegerich from whom we can get information? The answer to questions like these in the past has been be patient---but I'm a squeaky wheel today.

5.Are there unexplained absences from meetings or public forums by Rick Sullivan in September?

6.My last question is kind of subjective, and maybe unanswerable. Dr. Bourisaw seems like a person who tries to work with others in very trying circumstances. As I read the sketchy, never to be trusted Post Dispatch report regarding her testimony, I wonder how much conflict in direction (if any) of slps there is among---1.Bourisaw 2.Kent King and the state board 3. Rick Sullivan 4.Mayor Slay 5.Governor Blunt 6.Richard Gaines 7 others that I missed.

I know it might come across as insensitive not to mention the students or their parents---but I have to wonder just how much say they actually have until the governing structure is clarified.

Has Mayor Slay made any official statement regarding the legal situation of Coach Irons? Does the Mayor's support of Williams [who refused to fire Irons] extend to the Irons' situation?
