Judge: SAB Controls SLPS Finances

By Antonio D. French

Filed Friday, July 13, 2007 at 4:53 PM

BREAKING NEWS

The elected board may not be happy with receiving what it asked for by forcing the issue.

Sources say Judge Richard Callahan has ruled against the Board of Education and placed the finances of St. Louis Public Schools under the control of the Special Administrative Board. A formal written ruling is expected shortly.

SMACKDOWN! For those who think Callahan is just stalling, you can see where this is going. He is going to rule that the SAB is legal and their work has not not adversely impacted the operation of the district.

Why doesn't the SLPS board just try to work with the SAB? Because they are just as power hungry and previous boards!

well my 2 cents worth is that the judge will over all rule with the sab the case will go to the supreme court and the supreme court will rule that none of this should have ever happened! and after 2 years of this game and all the dust has settled it will be too late and the "power brokers" of this city will have what they wanted all the schools charter schools and all the excess cash out of the pension fund to build ball park village

I am one of those who thinks callahan is stalling. There are political consequences (which should not matter) to ruling aginst the sab. There are constitutional consequences to ruling against a bloc of voters who have been disenfranchised in favor of the very politicians they have been giving a rough way.

Slay has had his last four endorsed candidates rejected, and Blunt, understandably, did not get a lot of votes from those who have been disenfranchised.

The longer he stalls, the softer the consequences of ruling in favor of the sab----he will be able to justify the takeover because reversing it would cause more chaos, which would be "unfair".

The pd said maybe in September, they will get a court date.

Peter proved that a tro is not as tough to acquire as we thought it was.

No Time to Quit!!

SLPS Elected Board must prove that the statue that the State is using to transfer goverance of St. Louis Public Schools is unconstitutional. Until the statue is ruled unconstitutional, SAB will prevail for three, six years, or longer!

Are there any SLPS parents and residents who are interested in pursuing a (second) separate legal challenge from the SLPS Board of Education?

The statue the State is using clearly violates Missouri Constitution, the U.S. Constitution, and the Voting Rights Acts. The Missouri legislators who approved this statue should have narrowly tailored it to meet the "compelling interest of the government" without violating the constitutional rights of St. Louis citizens.

It does appear that this Judge is leading toward the state's position. I hope that SLPS elected board pursue this legal challenge ALL THE WAY to the U.S. Supreme Courts,if necessary; and if they do I hope the St. Louis community has the will and courage to support their efforts. At the same time, we must all do whatever we can to help SLPS students succeed.

Personally, this is not about who sits on the board but protecting the constitutional rights of St. Louis citizens and taxpayers.
